TERMS AND CONDITIONS - DONATE AND WIN PROMOTION
The Promotion
Information on how to enter the Promotion forms part of these terms and conditions of entry. Entry into the Promotion is deemed acceptance of these terms and conditions.
This Promotion and Competition is a fundraising appeal to be conducted to raise funds for the benefit of The Alannah and Madeline Foundation (“the Promoter”) of Level 1, 256 Clarendon Street, South Melbourne, Victoria (ABN 96 514 115 810.) (“the Promotion”).
The Promotion commences at 12.01am Australian Eastern Daylight Saving Time (AEDST) on 24 December 2015 and closes at 11.59pm (AEDST) on 25 January 2016 (Promotion Period).
Entry into the Promotion is open to Australian residents only subject to paragraph 37 of these Terms and Conditions (Eligible Entrants), excluding directors, management, agents, employees (and their immediate families) of the Promoter and/or Cricket Australia Limited (ABN 53 006 089 130) (Cricket Australia) or Handling Matters Pty Ltd (ABN 20 098 648 616) and each of their related bodies corporate.
If an entrant is under 18 years of age they must first obtain the consent of their parent or legal guardian before entering the Promotion.
Entry to the Promotion
To enter, Eligible Entrants must, during the Promotion Period:
Log onto the website www.amf.org.au/win
Make a minimum online donation of $10 or more to The Alannah and Madeline Foundation via the website www.amf.org.au/win; and
Register their details including (but not limited to) name, date of birth, phone number, home address and e-mail address.
Incomplete or incomprehensible entries will be deemed invalid.
Eligible Entrants are permitted one entry only (multiple entries are not permitted and will be deemed invalid).
The Promoter is not responsible for any technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including the entrant’s identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.
Prize Draw and Notification of Winner
The draw will take place at 12:00pm (AEDST) on 28 January 2016 at the offices of Handling Matters offices – Unit 1, 3 Green Street Brookvale NSW 2100.
The winner will be determined by an automated random draw by Handling Matters of all eligible entries. There will be one winner only.
The result of the draw is final and no correspondence will be entered into.
The winner will be notified in writing by email (using the details provided on the entry form at the time of entry) within 2 business days after the draw and their name will be published on the Promoters website on 29 January 2014 (www.amf.org.au/win) and at the Promoters premises for 7 days after the date of the draw.
The winner is responsible for ensuring that his/her details provided via the entry form on www.amf.org.au/win at the time of entry, are accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details.
Prize
One trip to Warner Bros Movie World on the Gold Coast, consisting of:
(a) Return economy airfares from the city where the winner resides in Australia to the Gold Coast for 4 adults;
(b) Two nights’ accommodation in 2 standard rooms suitable for 4 adults (at least three star) in the Gold Coast;
(c) 4 x Warner Bros Movie World Pass (general admission) for admission of 4 adults for one day entry;
(d) Return private car transfers from Gold Coast Airport to the accommodation;
(e) Return private car transfers from the accommodation to Warner Bros Movie World; and
The maximum national value of the Prize is $AU5718.
The prize is not transferable, exchangeable or redeemable for cash.
The prize must be redeemed by 31 December 2016. The prize cannot be redeemed during peak periods (as notified by the Promoter), including the following blackout dates 07/03/2016 to 14/03/2016, 25/03/2016 to 28/03/2016, 21/04/2016 to 28/04/2016, 11/06/2016 to 13/06/2016, 30/09/2016 to 03/10/2016 and 12/12/2016 to 31/12/2016.
The winner must provide all suppliers with a minimum of 60 days advance notice of intention to travel. Embargo restrictions apply during certain periods. Bookings are subject to conditions & availability (including but not limited to capacity limitations and other restrictions).
Prize Exclusions
If the Prize winner, or recipient or participant in a challenge or activity conducted in connection with this Promotion is younger than 18 years of age, a parent or legal guardian of that person must be present for the duration of that event or prize fulfilment, as one of the participants. The Promoter and Cricket Australia reserves the right to appoint a chaperone to accompany such participants. The participants agree to the chaperone being present with them for the duration of the prize and agree to comply with any reasonable directions or guidelines notified to them by the Promoter, Cricket Australia or their chaperone.
Unless expressly stated in these terms and conditions, all other expenses are the responsibility of the winners (and their companions) including but not limited to current passports, visas, meals, spending money, transport to and from departure and arrival points, transfers, drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, airport taxes (including departure taxes), fuel surcharges, energy surcharges, gratuities, services charges, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs. A credit card imprint or cash deposit may be required from the winner or their parent/guardian at check-in to the hotel, for all incidental charges.
By entering the Promotion, and by collecting a Prize, the winner and/or their parent/guardian acknowledge and accept that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter, Cricket Australia and the prize suppliers are not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the winner to enquire about local issues and conditions at destinations prior to travel. The Promoter and Cricket Australia do not guarantee that the winner will enjoy a Prize or be suited to the type of Prize that is offered.
The winner must travel on the same flights and itinerary as their travelling companions. Each winner and their travelling companions will need to make their own way to their nearest capital city airport to board their flights and are responsible for all transfers and charges. Frequent flyer miles cannot be accrued on any airfare connected with this Promotion. Flights and accommodation are subject to availability at the time of booking and cannot be exchanged for other destinations.
Compliance with any health or other government requirements (including immigration) is the responsibility of each winner and their travel companions. All prize travel will be subject to the third party provider’s terms and conditions. The Promoter and Cricket Australia accept no liability where a winner or travel companion is unable to fulfil any health or other government requirements.
The Promoter and Cricket Australia make no representation as to the safety, conditions or other issues that may exist at any destination.
General
If for any reason this Promotion is not capable of running as planned, including (but not limited to) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, the Prize becoming unable to be claimed or donated or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion or the awarding of the Prize, the Promoter reserves the right in its sole discretion to take any action that may be available, and to cancel, terminate, modify or suspend the Promotion or substitute another Prize, subject to any direction given under State permit regulations.
In the case of the intervention of any outside agent or event which naturally changes the result or presents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same condition subject to state legislation.
In the event of any entrant being unable to satisfy these terms and conditions or forfeiting or not claiming the Prize by 12.00pm (AEST) 16 December 2016, the Promoter may conduct such further draws on 20 December 2016 as are necessary in order to distribute the Prize if unclaimed by that date, subject however to any written directions given under applicable law. Any second chance draw Prize winner will be notified in writing by email (using the details provided via the entry form on www.amf.org.au/win at the time of entry) within 2 business days following the draw and their name published on the Promoters website on or before 22 December 2016 (www.amf.org.au/win) and at the Promoters premises for 7 days after the date of the draw.
The Promoter, its related bodies corporate and their respective officers, employees, contractors, agents and Cricket Australia will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this Promotion, the promotion of this Promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and Cricket Australia and which prevents the Promoter and Cricket Australia from complying with these terms and conditions, the Promoter and Cricket Australia will not be liable for any failure to perform or delay in performing its obligations and the Promoter and Cricket Australia reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this Promotion.
Entry details remain the property of the Promoter. The Foundation collects personal information about you to enable you to participate in this promotion. To facilitate your participation, the Foundation may disclose your personal information to other companies associated with this Promotion including Cricket Australia. A Participant’s personal information may be disclosed to State and Territory lottery departments and winner’s names published as required under the relevant lottery legislation. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting a prize. Entrants consent to the Promoter and Cricket Australia using personal information provided in connection with this Promotion for the purposes of facilitating the conduct of the Promotion and awarding any prizes, (including to MDSA and any applicable statutory authorities). Without limiting the foregoing, Entrants' personal information provided in connection with this Promotion will be handled in accordance with the Promoter's Privacy Statement, a copy of which is available at available at www.amf.org.au.
The Promoter and Cricket Australia accept no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
The Foundation and Cricket Australia shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or sustained in connection with the Prize, except for any liability which cannot be excluded by law.
The Foundation and Cricket Australia accept no responsibility for any kind of loss or liability suffered or incurred by any of the Participants in relation to the Promotion and/or Competitions. The Participants release the Foundation its related bodies corporate, affiliates, officers, agents, employees and Cricket Australia, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize or the Promotion. Without limiting the foregoing, the released parties will not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the Prize.
Residents from South Australia are not eligible to enter this competition due to state licensing requirements. Any entries from South Australia will be deemed invalid.
